Continues on Revision of Uniform Commercial Code Articles 2 and
2A
The American Law Institute (ALI) and the National Conference of
Commissioners on Uniform State Laws (NCCUSL), the two organizations
jointly responsible for drafting, updating, and promulgating the
Uniform Commercial Code (UCC), are continuing the effort to revise
Article 2 (Sales) and Article 2A (Leases) of the UCC.
The Revision to UCC Articles 2 and 2A had been scheduled for final
approval by NCCUSL at NCCUSL's Annual Meeting in St. Augustine,
Florida, July 28th through August 4th, and was considered there
by the Committee of the Whole. However, NCCUSL decided to defer
final approval action by it for one more year. The ALI had already
determined to act on UCC Articles 2 and 2A in 2001; moreover, discussions
with interested parties about some provisions had not been concluded.
Deference to these considerations seemed in order.
The Drafting Committee to Revise UCC Articles 2 and 2A will meet
in November. The draft will then be considered by the ALI Council
at its midyear meeting in December. The final version is currently
scheduled to receive action by the ALI at its annual meeting in
May 2001, and by NCCUSL at its annual meeting in August 2001.
The UCC has achieved substantial uniformity of commercial law throughout
the United States through enactment in basically uniform form in
all 50 states as well as the District of Columbia, the US Virgin
Islands, and Puerto Rico. The present revision of Articles 2 and
2A is part of an ongoing undertaking by the ALI and NCCUSL to modernize
the UCC, originally promulgated in 1951, and keep it responsive
to contemporary commercial realities.
The drafting committee to revise UCC Articles 2 and 2A is chaired
by William H. Henning of Columbia, Missouri. Other committee members
include: Boris Auerbach, Wyoming, Ohio; Marion W. Benfield, Jr.,
New Braunfels, Texas; Byron D. Sher, Sacramento, California; and
James J. White, Ann Arbor, Michigan. The American Law Institute
Representatives are Amelia H. Boss, Philadelphia, Pennsylvania;
and Neil B. Cohen, Brooklyn, New York. Henry D. Gabriel, Jr., of
New Orleans, Louisiana, is the committee's reporter.
