NEW DRAFTING AND STUDY COMMITTEES TO BE APPOINTED
August 23, 2002 — At its 111th Annual Meeting in Tucson, Arizona, July 26 through
August 2,
the Executive Committee of the National Conference of Commissioners on Uniform
State Laws
authorized the appointment of three new drafting committees and six new study
committees.
These new committees will be appointed shortly.
The three new drafting committees which will begin working on new acts are:

Committee to Draft International Conciliation
Amendments to the Uniform Mediation Act. The UN Commission on International
Trade Law (UNCITRAL) has completed a new Model Law on Conciliation.
This model law provides basic rules for the use of mediation (called conciliation
in international law) to resolve commercial disputes for parties to international
transactions. The standing committee of the UMA will be activated as a drafting
committee to draft amendments to the UMA consistent with the UNCITRAL model
act.

Drafting Committee on Uniform Certificate of
Title Act. Each year, close to 70 million motor vehicles and 17 million
watercraft are titled in the United States. State law on the subject varies
considerably. This drafting committee will examine major elements of certificate
of title laws, including centralized records of titling and transfer; medium
neutrality to facilitate electronic records; and state to state recognition.

Drafting Committee on Uniform Real Property Electronic
Recordation Act. This committee will draft an act on the subject of
electronic recordation of real estate transactions. There is currently little
or no legislation authorizing electronic recording, so a uniform law is
especially timely. |
The six new study committees which will consider subjects for possible future
drafting are:

Study Committee on an Omnibus Business Organization
Code. This committee will investigate the feasibility of a Business
Organization Code that would include both profit and non-profit, corporate
and non-corporate business organizations. The study should include a survey
of business organization forms, statutes and regulations, and will consult
with other organizations in its efforts. |

Study Committee on a Business Cooperatives
Act. This committee will review state cooperative statutes, including
statutes regulating farm and utility cooperatives. |

Study Committee on Public Health Emergency
Response Authority. This committee will examine state public health
laws with regard to epidemic emergencies, including existing state divisions
of authority. |

Study Committee on Real Property Title Clearance
Methods and Procedures. This committee will research the problem of
discharge and release of both residential and commercial mortgages. A law
in this area could provide a mechanism for a borrower or insuring title
company to obtain a quick and simple title clearance without cost to the
borrower when a mortgage is paid off. |

Study Committee on Mortgagee Access to Rents
from Income-Producing Property. This committee will study the problem
of mortgagee access to rent from income property. A uniform solution to
this problem would serve to ease securitization, lower transaction costs,
and make mortgages more available. |

6.

Study Committee on Revision/Expansion of the
Uniform Money Services Act. The standby committee on UMSA will be activated
as a study committee to consider revision of UMSA, in light of the events
of 9/11, and recent developments in this field. |
Drafting committees composed of commissioners, with participation from observers,
advisors and
reporter-drafters, meet throughout the year. Tentative drafts are not submitted
to the entire
Conference until they have received extensive committee consideration.
Proposed acts are subjected to rigorous examination and debate for at least
two annual meetings
before they become eligible for designation as Conference products. The final
decision on whether
an act is ready for promulgation to the states is made near the close of an
annual meeting, on a
vote-by-states basis, with affirmative vote of 20 or more states necessary for
final appraisal.
